Domestic Abuse: What the Law Says
Domestic abuse is any behaviour used to control, threaten, intimidate or harm you. It can be a single incident or a pattern of conduct and may be carried out by:
- A partner or ex‑partner
- A family member
- Someone in a caring role
Domestic abuse affects people of all ages, genders and backgrounds
It is not limited to physical violence. The law also recognises abuse where there is fear, control or coercion, including:
- Controlling or coercive behaviour
- Emotional or psychological abuse
- Financial or economic abuse
- Sexual abuse
- Threats, harassment or intimidation
- Abuse involving children or pets
If you are being controlled or made to feel afraid, the law can protect you.
You do not need physical injuries or written evidence to obtain protection. Emotional abuse is recognised by the courts.
Legal Protection Available
Non‑Molestation Orders
A non‑molestation order is a court injunction designed to stop abuse immediately. It can prevent the abuser from:
- Threatening or harassing you
- Using violence
- Contacting you in any way
- Coming near your home, workplace or children
Breaching a non‑molestation order is a criminal offence. The police have the power to arrest immediately.
How quickly can it be arranged?
In urgent cases, we can apply within 24–48 hours. Courts regularly grant orders without notifying the abuser where safety is at risk.
How long does it last?
Typically 6–12 months, with extensions available where necessary.
Occupation Orders
An occupation order regulates who can live in the family home. It can:
- Exclude the abuser from the property
- Allow you and your children to remain in the home
- Set enforceable boundaries around access
You do not need to own the property to be protected.
Duration
Usually up to 6 months, with longer protection available in serious cases.
