Client Snapshot
Industry: Personal Injury
Client Type: Individual
Location: UK
Profile
We acted for a middle‑aged man who sustained extensive and life‑changing injuries in a serious road traffic collision. Prior to the accident, he was working as a self‑employed bookkeeper and studying to further his qualifications, with the intention of increasing his earning capacity. As a result of the accident, he was left with significant permanent disability and has been unable to return to work.
The Challenge
The Claimant sustained multiple serious injuries, including complex upper limb fractures, spinal and thoracic injuries, and psychological symptoms. These injuries required multiple surgical interventions and prolonged rehabilitation.
Key challenges included:
- The severity and multiplicity of injuries resulting in permanent functional impairment
- Loss of capacity for work and the need to evidence long‑term disadvantage on the labour market
- Ongoing and future care, therapy and assistance needs
- A detailed and high‑value Schedule of Loss spanning past and future losses
- Ensuring early access to rehabilitation to promote recovery and independence
Objectives
- To secure early admissions on liability and funding for rehabilitation
- To ensure the Claimant received appropriate medical, therapeutic and care support
- To accurately quantify substantial past and future financial losses
- To negotiate a settlement reflecting the long‑term impact of the injuries
- To minimise delay and uncertainty for the Claimant
Our Approach
From the outset, the claim was managed collaboratively, with an early admission of liability from the Defendant’s insurer. This enabled interim payments to be secured promptly and rehabilitation to commence without delay, including case management, occupational therapy, physiotherapy and psychological support.
We worked closely with medical experts to fully understand the extent of the Claimant’s injuries and long‑term prognosis. A comprehensive and carefully evidenced Schedule of Loss was prepared, addressing loss of earnings, future care and assistance, therapy, equipment, accommodation needs and other consequential losses.
Work Delivered
- Securing early admission of liability
- Obtaining interim payments to fund early rehabilitation
- Coordinating medical, care and occupational therapy evidence
- Preparation of a detailed Schedule of Financial Loss
- Ongoing liaison with the Defendant on rehabilitation and quantum
- Negotiation of a substantial settlement at a joint settlement meeting
Results & Impact
- Liability admitted at an early stage
- Rehabilitation funding secured promptly, supporting recovery and independence
- A substantial settlement of £902,476 achieved
- Financial security for the Claimant in light of permanent disability
- Compensation reflecting lifelong loss of earnings, care needs and reduced independence
Key Takeaway
Early collaboration, prompt liability admissions and proactive rehabilitation can significantly improve outcomes in serious personal injury claims. By combining early interim funding with robust medical evidence and a detailed Schedule of Loss, it is possible to secure substantial compensation while prioritising the injured person’s recovery and long‑term wellbeing.
